Penalty Place On RODA? Date To Be Removed From RODA Determination Type Orders Pursuant to section 299(1) of the Uniform Law the Victorian Legal Services Commissioner finds that the Respondent has engaged in unsatisfactory professional conduct and makes the following orders 1.Pursuant to section 299(1)(b) of the Uniform Law the Respondent is reprimanded. 2 Pursuant to section 299(1)(c) of the Uniform Law the Respondent must give an apology to 'the complainant'. The apology must be in writing. Within 21 days of the date of this determination the Respondent must send the apology to the Victorian Legal Services Commissioner (the Commissioner) for approval. The Commissioner may request that the Respondent make any reasonable amendments. Once approved the Commissioner will forward the apology to 'the complainant'. 3. Pursuant to section 299(1)(e) of the Uniform Law the Respondent must complete three additional continuing professional development (CPD) units in the area of ethics and professional responsibility in the 2025-26 practising year that is in addition to the standard CPD requirements under the Legal Profession Uniform Continuing Professional Development (Solicitors) Rules 2015 which require the completion of at least ten CPD units in a practising year at least one of which must be in the area of ethics and professional responsibility. As such the Respondent must complete a total of at least 13 CPD units in the 2025 to 26 practising year at least four of which must be in the area of ethics and professional responsibility. If the Respondent does not apply for a practising certificate for the 2025 to 26 practising year this order is deferred to any subsequent practising year in which the Respondent applies for and is granted a practising certificate.
