Professional misconduct under the Legal Profession Uniform Law (Vic)

Findings / Charges: 1. Professional misconduct within the meaning of section 297(1)(a) and 298(b) of the Uniform Law in that the Respondent on various dates between approximately 7 April 2016 and approximately 18 July 2017 acted for a client in conflict with the duties owed to a former client. 2. Professional misconduct within the meaning of sections 297(1)(a) and (b) and 298(b) of the Uniform Law in that the respondent on various dates between approximately 19 May 2016 and approximately 28 December 2016 dealt directly with a person represented by another lawyer. 3. Professional misconduct within the meaning of section 297(1)(a) and (b) of the Uniform Law in that the respondent on or about 28 December 2016 facilitated a clients contravention of court orders. 4. Professional misconduct within the meaning of sections 297(1)(a) 298(a) 298(b) and 466(6) of the Uniform Law in that the respondent on various dates between 31 July 2018 and approximately 27 January 2020 failed to respond to the Applicants requirements to provide information. Orders: 1. Peter Flynn is reprimanded. 2. Peter Flynn pay a fine of $3500.00 to the applicant. 3. Peter Flynn pay the applicants costs fixed in the sum of $3000.00.
